Property Law Advice
Buying a rural property in inland Andalucia
Buying property in a rural area can be a great deal more complex than in an urban area.
Many rural areas are very remote and over time those areas might have had building regulations governed by local municipal town halls and larger urban authorities. This can lead to some confusion as different conditions and permissions to build could have prevailed in every municipality and sometimes even within the same municipality.
It is fair to say that one should proceed with a great deal of caution to guarantee a safe and legal purchase.
Some questions to be answered before buying:
-
Is this rural or urban land?
-
Is there a license?
-
Does the built property comply with the conditions of the building license (number of square meters, number of floors, number of buildings etc.)
-
Are there is any penalties pending on the property in the town hall?
-
Are there any construction or reform limitations in the area the house is built?
-
Are utilities of the property legally contracted for and legally connected?
-
Is it possible to formalise a mortage on the land or property?
-
Is the land and the plot legally registered under the name of the seller?
-
Are the square meters of the plot and the property registered in the land registry?
Fairway Lawyers will co-ordinate everything to do with the buying process from the early enquiries to the final contract so that buying in Spain, even in rural areas, becomes a pleasant and enjoyable experience.
